Please note that - may amend this Personal Data Protection Notice at any time without prior notice and will publish the amended or revised Personal Data Protection Notice on our portal. By signing up or accessing with - website or any of the services provided by - Group, you agree to the terms and conditions set out in this Privacy Policy, and you hereby acknowledge and agree that we may collect, use and process all Personal Data as described in this policy.

  1. Customer Data
    By using or continuing to use our services, you hereby authorise us to collect, store, and process any and all data provided by you or generated through your use of our services (“Data”) in accordance with this Agreement and the applicable policies such as the Privacy Policy detailed below. You are responsible for ensuring the information you provide us is accurate, complete and not misleading and that such information is kept up to date. The Data that we collect includes but is not limited to your sales data, transaction data, personal data, your customer’s personal data, your supplier’s personal data and any other commercial data. You hereby acknowledge and expressly consent that all Data provided by you in connection with this Agreement or generated through your use of other services from us shall, to the extent permitted by law, become and remain our property.
  2. Personal Data Protection
    In the event that we collect, use, disclose and/or process your or your suppliers or customer’s personal data, we will do so in accordance with the Personal Data Protection Act 2010 (“PDPA”) and the Privacy Policy accessible at https://scbiz.einvois2u.com.my/privacy-policy/. For the purpose of this Agreement, personal data shall have the meaning as set out under the PDPA. By using or continuing to use our services, you hereby acknowledge that you have read and understood the Privacy Policy and accept your legal rights and obligations with respect to data privacy.
  3. How We Use Your Data
    To give effect to this Agreement, you hereby agree that we may use, transfer and/or share your Data with our affiliates (including any parent company, subsidiaries, affiliates, or third parties that are directly or indirectly controlled by, or under common control of ours), business partners, service providers and other relevant third parties for any of the following purposes:
    • to provide our services to you;
    • to provide customer support;
    • to comply with the applicable laws or regulations, court order or other legal process and/or in response to a request by a government authority, law enforcement agency or similar body;

    • to better understand how you access and use our services, for the purposes of trying to improve our services and to respond to customer desires and preferences, including language and location customisation, personalised help and instructions, or other responses to your and other clients’ usage of our services;

    • to prevent or investigate any actual or suspected violations of this Agreement, fraud, unlawful activity, omission or misconduct, whether relating to your use of our services or any other matter arising from your relationship with us;
    • to respond to any threatened or actual claims asserted against us;
    • to store, host, and back up (whether for disaster recovery or otherwise) your Data under the Malaysian jurisdiction;
    • for marketing and advertising purposes;
    • to help us develop our new services and/or improve our existing services;
    • software verification or administering software upgrades;
    • our business and commercial transactions; and/or
    • any other purposes which we notify you of at the time of obtaining your consent.
  4. Third-Party Use Of Your Data
    Our services may link to, or contain advertisements from, third-party services or websites. You acknowledge that any Data including any personal data you provide to third-party services is governed by their end-user agreement or privacy policies, not ours. We do not accept liability for third-party services and are not responsible for their privacy practices. In the event we share your Data with third parties, we will ensure that third parties only use your Data under the conditions of this Agreement and according to instructions that include appropriate confidentiality and security measures. By agreeing to this clause, you consent to such third-party use and sharing of your Data as described herein. In addition, where we share your Data that includes any of your (or your customers’) personal data with any third parties, we will adhere to the Privacy Policy and will not share any of the personal data or identifiable information relating to you or your customers without your express consent. We may, however, share your (or your customers’) personal data in aggregated, anonymised, or pseudonymised forms with third parties for advertising purposes, ensuring that it cannot be used to identify you or your customers without your express consent.
